2. Quina "Informació Personal" recopilem?

 

Per oferir els nostres Serveis,

recopilem Informació Personal sobre els nostres Usuaris.

o utilitzes els nostres serveis,

i Informació Personal que recopilem d'altres fonts.​

2.1. Informació de l'usuari:

Per oferir-te els Serveis, hem de recopilar Informació Personal relativa a una persona física identificada o identificable (“Informació Personal”). Recopilem la Informació Personal que ens proporciones, la derivada de l'ús que fas dels Serveis i la d'altres fonts. Aquests són els tipus d'Informació Personal que recopilem sobre tu:

1.  Informació que ens proporciones. Quan et registres als nostres Serveis, t'inscrius a qualsevol esdeveniment de AP Marketing & Automation Consulting, et subscrius als nostres blogs o butlletins informatius, compres i/o et registres a sessions o plans, utilitzes qualsevol dels nostres Serveis; i/o quan et poses en contacte directament amb nosaltres per qualsevol canal de comunicació (per exemple tiquets de suport de AP Marketing & Automation Consulting, correus electrònics), ens pots proporcionar Informació Personal, com ara nom, adreça de correu electrònic, número de telèfon, informació de pagament (per a Usuaris amb Serveis de Pagament), informació que inclous en les teves comunicacions amb nosaltres i amb altres usuaris de la nostra plataforma, i Informació Personal continguda en documents escanejats o no escanejats.​

2. Informació que recopilem quan utilitzes els Serveis. Quan visites, descarregues i/o utilitzes qualsevol dels nostres Serveis, podem recopilar Informació Personal d'ús agregada, com ara l'activitat de navegació i de clics dels Visitants i Usuaris en els Serveis, heatmaps de la sessió i moviments de navegació, Informació Personal no identificativa sobre el dispositiu del Visitant o Usuari, sistema operatiu, navegador d'Internet, resolució de pantalla, configuració de llengua i teclat, proveïdor de serveis d'Internet, pàgines de referència/sortida, segells de data/hora, etc.​

3. Informació que recopilem d'altres fonts. Podem rebre Informació Personal sobre tu de fonts de tercers, com ara i) proveïdors de seguretat, proveïdors de detecció i prevenció de fraus, per exemple per ajudar-nos a filtrar usuaris associats amb fraus, ii) plataformes de xarxes socials, quan inicies sessió o et registres mitjançant el teu compte de xarxes socials, podem rebre Informació Personal d'aquest servei (per exemple, el teu nom d'usuari, Informació Personal bàsica del perfil) i, en alguns casos, podem recopilar Informació Personal d'empreses de millora de captació de clients potencials que ens ajuden a optimitzar la nostra oferta de serveis; iii) socis de publicitat i màrqueting per supervisar, gestionar i mesurar les nostres campanyes publicitàries.​

3. Per què recopilem aquesta "Informació Personal"?

 

Utilitzem l'Informació Personal que recopilem sobre tu

per oferir els nostres serveis i fer-los millors i més segurs.

També recopilem i utilitzem Informació Personal per posar-nos en contacte

amb els Usuaris i per complir amb les lleis que ens són aplicables.

Utilitzem la teva Informació Personal per a les finalitats següents:​​

1. Per oferir i operar els Serveis;

2. Per desenvolupar, personalitzar, ampliar i millorar encara més els nostres Serveis, basant-nos en les preferències, experiències i dificultats comunes o personals dels Usuaris;

3. Per proporcionar als nostres Usuaris assistència al client i suport tècnic continuat;

4. Per poder posar-nos en contacte amb els nostres Usuaris amb avisos generals o personalitzats relacionats amb el servei i missatges promocionals (com es detalla més endavant a la Secció 8);

5. Per ajudar-nos a actualitzar, ampliar i analitzar els nostres registres per identificar nous clients;

6. Per facilitar, patrocinar i oferir determinats concursos, esdeveniments i promocions, determinar l'elegibilitat dels participants, supervisar el rendiment, contactar amb els guanyadors i concedir premis i beneficis;

7. Per analitzar el nostre rendiment i activitats de màrqueting;

8. Per crear dades estadístiques agregades i altra informació agregada i/o inferida, que nosaltres o els nostres socis comercials puguem utilitzar per oferir i millorar els nostres serveis respectius;

9. Per oferir-te assistència professional;

10. Per millorar les nostres capacitats de seguretat de dades i prevenció de fraus;

11. Per complir amb qualsevol llei i normativa aplicable.​​

Es possible que utilitzem tècniques com l'“aprenentatge automàtic” (la llei europea es refereix a això com a “presa de decisions automatitzada”) per ajudar-nos a millorar els nostres serveis. Quan utilitzem l'aprenentatge automàtic, o bé: (i) encara tenim un ésser humà involucrat en el procés (i, per tant, no està totalment automatitzat); o (ii) utilitzem l'aprenentatge automàtic de maneres que no tenen implicacions significatives per a la privacitat (per exemple, traducció d'idiomes basada en la ubicació). També podem utilitzar l'aprenentatge automàtic per ajudar-nos a supervisar, identificar i suspendre comptes que envien correu brossa (spam) o realitzen altres activitats abusives o fraudulentes.​

 

Utilitzem la teva Informació Personal per a les finalitats establertes a la Secció 3 quan:​

1. El nostre ús de la teva Informació Personal es necessari per executar un contracte o per prendre mesures per començar un contracte amb tu (p. ex., per proporcionar-te un sistema de pagament, per oferir-te la nostra assistència al client i suport tècnic);

2. El nostre ús de la teva Informació Personal es necessari per complir amb una obligació legal o reglamentària rellevant que tinguem;

3. El nostre ús de la teva Informació Personal es necessari per donar suport a interessos legítims i fins comercials (per exemple, per mantenir i millorar els nostres Serveis i l'eficàcia de AP Marketing & Automation Consulting mitjançant la identificació de problemes tècnics), sempre que es dugui a terme d'una manera proporcionada i que respecti els teus drets de privacitat.​​

4. Com compartim la teva "Informació Personal"

i Usuaris d'Usuaris amb diversos tercers,

4.1. Proveïdors de Serveis Terciaris:

AP Marketing & Automation Consulting s'ha associat amb una selecció de proveïdors de serveis, els serveis i les solucions dels quals complementen, faciliten i milloren els nostres propis. Aquests inclouen serveis de hosting i co-location de servidors (co-location), xarxes de lliurament de continguts i comunicacions (CDN), serveis de seguretat de dades i ciberseguretat, serveis de facturació i processament de pagaments, registradors de noms de domini, serveis de detecció i prevenció de fraus, analítica web, serveis de distribució i monitorització de correu electrònic, grabació de sessions i serveis d'accés remot, mesurament del rendiment, optimització de dades i serveis de màrqueting, proveïdors de contingut i els nostres assessors legals i financers (col·lectivament, “Proveïdors de Serveis Terciaris”).​

En cas que AP Marketing & Automation Consulting comparteixi dades personals amb un Proveïdor de Serveis terciari que ofereixi serveis d'IA, AP Marketing & Automation Consulting s'assegurarà que el Proveïdor de Serveis terciari estigui sota l'obligació contractual de no utilitzar les dades per entrenar o millorar els seus models d'IA, en la mesura de les nostres capacitats.

4.2. Compliment de la Llei, Sol·licituds Legals i Deures:

AP Marketing & Automation Consulting pot divulgar o permetre l'accés a qualsevol categoria de la teva Informació Personal descrita en aquesta Política de Privacitat en virtut d'una sol·licitud legal, com ara una citació, procediments legals, ordre d' enregistrament o ordre judicial, o en compliment de les lleis aplicables, si creiem de bona fe que la llei ens ho exigeix, amb o sense avís previ.

4.3. Protecció de Drets i Seguretat:

4.4. Filials i Empreses Afiliades de AP Marketing & Automation Consulting:

Podem compartir la teva Informació Personal internament dins del nostre grup d'empreses, per a les finalitats descrites en aquesta Política de Privacitat. Per exemple, podem compartir la teva Informació Personal amb alexiapalau.com, la nostra filial amb seu als Estats Units d'Amèrica, en el procés de facilitar-te i proporcionar-te (i als teus Usuaris d'Usuaris) els nostres Serveis. La compartició d'Informació Personal per part de filials i empreses afiliades de AP Marketing & Automation Consulting a la Unió Europea i al Regne Unit amb filials de AP Marketing & Automation Consulting ubicades fora d'aquestes regions només tindrà lloc sota un mecanisme de transferència aprovat, com ara les Clàusules de tipus Contractual corresponents.​

4.5. En relació amb un canvi de control corporatiu:

A més, si AP Marketing & Automation Consulting o qualsevol de les seves filials experimenta un canvi de control, inclòs per fusió, adquisició o compra de la majoria dels seus actius, la teva Informació Personal es pot compartir amb les parts involucrades en aquest esdeveniment.​

4.6. Segons les teves indicacions addicionals:

Els Serveis de AP Marketing & Automation Consulting et permeten, mitjançant diferents tècniques, contractar i utilitzar diversos serveis, productes i eines de tercers per millorar la teva experiència al lloc web o mòbil, incloent-hi, sense limitació, aplicacions i widgets que t'ofereixen tercers a través del Lloc Web de Wix (inclosa la Wix App Market), proveïdors de pagament de comerç electrònic, dissenyadors de tercers que puguin ajudar amb el lloc web, etc. (col·lectivament, “Serveis de Tercers”). Si decideixes interactuar amb aquests Serveis de Tercers, és possible que tinguin accés a l'Informació Personal dels nostres Usuaris d'Usuaris recopilada a través dels nostres llocs web o mòbils i la processin. Per exemple:​

 

a) Pàgines emmarcades: els nostres Serveis poden integrar Serveis de Tercers directament als nostres llocs web o mòbils, com ara mitjançant tècniques d'emmarcat de pàgines ("Enmarcació") per servir contingut a/o des de Serveis de Tercers o d'altres parts. En aquestes circumstàncies, els Serveis de Tercers poden recopilar Informació Personal dels nostres Usuaris d'Usuaris.

 

b) Desenvolupadors del Mercat d'Applications (App Market): utilitzem aplicacions de desenvolupadors de tercers (“Desenvolupador(s) de Tercers”) a través de la Wix App Market (“Aplicació(ns) de Tercers”) per ser utilitzades pels Usuaris, que es poden integrar als nostres llocs web o mòbils. Cada Desenvolupador de Tercers està vinculat per l'Acord de Socis de la Wix App Market, que, entre altres coses, restringeix les maneres en que aquests desenvolupadors poden accedir, emmagatzemar, compartir i utilitzar l'Informació Personal que nosaltres i/o els nostres Usuaris d'Usuaris els proporcionem.​

 

c) Funcions de xarxes socials: els nostres Serveis poden integrar certes funcions de xarxes socials, widgets i funcions d'inici de sessió única, com ara “Facebook Connect” o “Google Sign-in” (“Funcions de Xarxes Socials”) als nostres llocs web o mòbils. Aquestes Funcions de Xarxes Socials poden recopilar certa Informació Personal dels nostres Usuaris d'Usuaris, com ara identificadors, inclosos nom, àlies, identificador personal únic, identificador online, adreça de protocol d'Internet (IP), adreça de correu electrònic o altres identificadors similars. Les Funcions de Xarxes Socials estan allotjades per un tercer o directament als nostres Serveis.​

 

Tingues en compte que, en els exemples enumerats anteriorment en aquesta Secció 4.6, AP Marketing & Automation Consulting actua merament com a plataforma intermediària que et permet contractar els serveis d'aquests Serveis de Tercers (inclosos, entre d'altres, Desenvolupadors de Tercers, Aplicacions de Tercers i Funcions de Xarxes Socials) amb els quals interactues directament i a la teva discreció. En aquest sentit, AP Marketing & Automation Consulting actua com a proveïdor de serveis per a tu, divulgant informació als Serveis de Tercers en el teu nom. AP Marketing & Automation Consulting només compartirà la Informació Personal dels nostres Usuaris d'Usuaris amb Serveis de Tercers seguint les teves indicacions o amb el teu permís, i no és ni serà responsable de cap manera del tractament d'aquesta Informació Personal per part d'aquests Serveis de Tercers.​

 

AP Marketing & Automation Consulting no controla ni és responsable de les accions o polítiques de cap Servei de Tercers, i l'ús de qualsevol Servei de Tercers és sota el teu propi risc. Et recomanem que revisis qualsevol política de privacitat que acompanyi un Servei de Tercers i demanis a aquest Servei de Tercers qualsevol aclariment que puguis necessitar abans de decidir instal·lar i/o utilitzar els seus serveis.​​

5. On emmagatzemem/tractem la teva "Informació Personal"

 

Per tal de proporcionar els Serveis de

AP Marketing & Automation Consulting als nostres usuaris,

AP Marketing & Automation Consulting pot transferir

informació personal a filials de AP Marketing & Automation Consulting

i tercers proveïdors que estan compromesos contractualment

a protegir i assegurar les teves dades.​

5.1. Transferències de Dades;

AP Marketing & Automation Consulting tracta dades sobre persones de tot el món i pot transferir la teva Informació Personal fora del teu país. La teva seguretat, privacitat i confidencialitat són la nostra màxima prioritat i per això AP Marketing & Automation Consulting duu a terme un procés d'avaluació que inclou la revisió de les lleis de privacitat en aquests països per validar que tenen lleis de protecció de dades sòlides.​

5.2. Decisió d'Adequació de la UE;

​

La informació personal de l'Usuari està controlada per AP Marketing & Automation Consulting als Estats Units d'Amèrica, que la Comissió Europea considera com un país que ofereix un nivell de protecció adequat per a la Informació Personal dels residents dels Estats membres de la UE (veure aquí, amb Preguntes Freqüents aquí).​

5.3. Transferències de Dades fora de la UE/Espai Econòmic Europeu/Regne Unit;

Si et trobes a Europa o al Regne Unit, quan transferim la teva Informació Personal a una ubicació fora d'Europa, ens assegurarem que (i) hi hagi un nivell de protecció considerat adequat per la Comissió Europea o (ii) que s'apliquin les Clàusules de Tipus Contractuals corresponents, o (iii) complim amb el Marc de Privacitat de Dades (Data Privacy Framework) segons sigui aplicable a les transferències de dades als Estats Units i que s'especifica a la clàusula 5.4 a continuació, o (iv) utilitzem un altre mecanisme de transferència reconegut legalment a la jurisdicció aplicable.​

Quan AP Marketing & Automation Consulting transfereix Informació Personal de la UE a un tercer país que la Comissió Europea no hagi determinat que protegirà adequadament la teva informació, AP Marketing & Automation Consulting s'assegura que ha pres mesures addicionals per complir amb les lleis europees de protecció de dades.​

5.4. Marc de Privacitat de Dades (Data Privacy Framework)

Marc de Privacitat de Dades: AP Marketing & Automation Consulting i les seves futures entitats cobertes compleixen amb el Marc de Privacitat de Dades (Data Privacy Framework "DPF”) que integra el Marc de Privacitat de Dades UE-EEUU (“EU-U.S. DPF”) i l'Extensió del Regne Unit a UE-EEUU. DPF, tal com estableix el Departament de Comerç dels EEUU, la Comissió Europea i el Govern del Regne Unit respecte a la recopilació, ús i retenció d'informació personal transferida des de la Unió Europea i el Regne Unit (i Gibraltar) als Estats Units. AP Marketing & Automation Consulting ha certificat davant l'Administració de Comerç Internacional (ITA) dels EEUU, dins del Departament de Comerç dels EEUU, que s'adhereix als Principis del Marc de Privacitat de Dades. Si hi ha cap conflicte entre els termes d'aquesta Política i els Principis del Marc de Privacitat de Dades, prevaldran els Principis del Marc de Privacitat de Dades. El compromís de AP Marketing & Automation Consulting de sotmetre la informació personal descrita en aquesta Política al Marc de Privacitat de Dades està subjecte a les facultats d'execució i investigació de la Comissió Federal de Comerç dels Estats Units (FTC).​

AP Marketing & Automation Consulting pot compartir informació personal amb tercers en certes circumstàncies descrites en aquesta Política, subjecte a les obligacions en virtut dels Principis del Marc de Privacitat de Dades que s'extenen a tercers que actuen com a agents que ens ajuden a gestionar el nostre negoci i oferir serveis, i AP Marketing & Automation Consulting continua sent responsable si un tercer que actua com a agent nostre tracta informació personal subjecta a aquesta Política de manera inconsistent amb aquesta, excepte quan AP Marketing & Automation Consulting no sigui responsable de l'esdeveniment que hagi causat el dany.

En compliment dels Principis del Marc de Privacitat de Dades, AP Marketing & Automation Consulting es compromet a resoldre les queixes sobre la nostra recopilació o ús de la teva informació personal. AP Marketing & Automation Consulting s'ha compromès a més a remetre les queixes no resoltes del Marc de Privacitat de Dades a un proveïdor alternatiu de resolució de disputes ubicat als Estats Units. Si tens un dubte no resolt sobre la privacitat o l'ús de dades que no hàgim abordat de manera satisfactòria, posa't en contacte amb el nostre proveïdor de resolució de disputes de tercers amb seu als EUA, TRUSTe, a https://feedback-form.truste.com/watchdog/request per obtenir més informació o per presentar una queixa. Els serveis s'ofereixen sense cap cost per a tu.

Si no reps un reconeixement oportú de la teva queixa per la nostra part, o si no hem abordat la teva queixa a la teva satisfacció, pots  - sota determinades condicions descrites al lloc web del Marc de Privacitat de Dades -  invocar un arbitratge vinculant quan s'hagin esgotat altres procediments de resolució de disputes. Per a més informació sobre aquesta opció, consulta l'Annex I dels Principis del Marc de Privacitat de Dades.

6. "Informació Personal" dels Usuaris d'Usuaris de Wix

​

Wix pot recopilar i processar Informació Personal sobre els nostres usuaris.​

​

Wix pot recopilar, emmagatzemar i processar certa Informació Personal dels Usuaris d'Usuaris (“Informació dels Usuaris d'Usuaris”), únicament en el nostre nom i sota la nostra direcció. Per exemple, podem importar contactes de correu electrònic de serveis de tercers com Gmail, o recopilar i gestionar contactes a través del nostre Lloc Web. Aquests contactes s'emmagatzemen amb Wix, en el nostre nom.

 

Per a aquestes finalitats, Wix actua i serà considerat com a “Encarregat del Tractament” i no com a “Responsable del Tractament” (tal com es defineixen aquests dos termes en majúscula al Reglament General de Protecció de Dades de la Unió Europea (“RGPD”)) d'aquesta Informació dels Usuaris d'Usuaris.

El tractament de l'Informació Personal dels Usuaris d'Usuaris tindrà lloc dins del territori de la Unió Europea, Israel o un tercer país, territori o un o més sectors especificats dins d'aquest tercer país del qual la Comissió Europea hagi decidit que garanteix un nivell de protecció adequat, i aquest tractament i transferència es realitzaran d'acord amb l'Annex de Tractament de Dades - Usuaris (“DPA”). Qualsevol transferència i tractament en un tercer país fora de la Unió Europea que no garanteixi un nivell de protecció adequat segons la Comissió Europea, es durà a terme sota un mecanisme de transferència aprovat, tal com es detalla al DPA.

Per a més informació sobre com Wix pot gestionar l'Informació Personal dels Usuaris d'Usuaris (que pot ser rellevant per a qualsevol avís específic que es proporcioni i/o consentiment que s'obtingui dels nostres Usuaris d'Usuaris), consulta les Seccions 4, 12 i 13 de Wix.

Si nosaltres sol·licitem a Wix que elimini qualsevol Informació Personal dels Usuaris d'Usuaris, Wix respondrà a aquestes sol·licituds de manera oportuna després de la verificació i d'acord amb la llei aplicable (per exemple, trenta (30) dies sota el RGPD). A menys que indiquem el contrari, Wix mantindrà l'Informació Personal dels seus Usuaris d'Usuaris durant el període establert a la Secció 12 de la Política de Privacitat de Wix.​​​

7. Ús de galetes (cookies) i altres tecnologies de tercers
